Legal and Ethical Standards for Digital News Websites
- Compliance with Laws: Digital news websites adhere to:
- The Constitution of India
- Over 30 media-related laws
- Relevant provisions of the IPC and CrPC
- The Information Technology Act, 2000 (where applicable)
- Journalistic Ethics: These platforms follow accepted norms and maintain high professional standards through:
- Multi-layered self-regulatory ethics and codes
- Rigorous newsroom processes for journalists and editors
- Accuracy, Transparency, and Fairness:
- Avoid publishing inaccurate, baseless, or distorted material
- Mandatory pre-publication verification
- Avoid defamation
- Adhere to applicable laws and rules
- Right of Reply:
- Include comments or responses from individuals or parties against whom allegations are made
- Incorporate responses received post-publication
- Update articles with new developments as requested by the concerned party, with the date of the update indicated
- Corrections and Deletions:
- Edit or delete portions of articles found to contain false or inaccurate information upon receiving valid documentation
- Delete entire articles if found to be wholly inaccurate
- Intellectual Property Rights:
- Respect copyright for text, photographs, plans, diagrams, and cartoons
- Obtain prior permission for using copyrighted material and acknowledge moral and ownership rights
- Pay fees or royalties if required
- Use third-party trademarks and service marks only with permission or under fair use
- Edit, delete, or take down infringing content upon request
- Reporting Sensational Matters and Crimes:
- Preserve the presumption of innocence
- Avoid speculative comments on evidence, witnesses, the accused, and victims
- Ensure fact-based and unbiased reporting, particularly in sensitive cases like sexual harassment, child abuse, rape, and communal disputes
- Information Technology Act Compliance:
- Follow Sections 67, 67A, and 67B regarding penalties for publishing obscene or explicit material
- Grievance Redressal Mechanism:
- Adhere to the grievance redressal mechanism outlined in the Information Technology Act, 2000
- Appoint a grievance officer to address complaints within 36 hours and resolve them within a month
- Training and Awareness Programs:
- Conduct regular training for editorial staff on laws including:
- The Constitution of India
- Media-related laws like The Indecent Representation of Women (Prohibition) Act, Copyright Act, and Right to Information Act
- Relevant provisions of IPC, CrPC, civil and criminal defamation, IPR, Juvenile Justice, POCSO, and others
- Avoid naming or identifying victims or perpetrators, especially minors
- Exercise caution in reporting on communal or religious disputes, ensuring facts are verified and presented to promote harmony
- Take special care in reporting court and judicial matters, ensuring accurate and unbiased coverage of both victim and accused perspectives
- Respect for Privacy:
- Respect the privacy of individuals, especially those not in public life
- Avoid publishing identifying details and photographs of victims and their locations
